A Quiet Title action is the legal process used to resolve disputes over the ownership of real property and to establish clear title by eliminating claims or defects that may affect the property.

This often arises in situations involving contested property boundaries, conflicting claims of ownership, contested liens, or unclear property titles. Quiet title actions are perhaps the primary focus of our practice.

In Florida, quiet title actions are largely comprised of two areas: Clear to Sell and Tax Title Services. Tax Title services are perhaps the most nuanced and unique of the quiet title services, and are a necessary part of officially claiming ownership of the property you purchase at a tax deed sale. When you purchase property at a tax deed sale, expediency in taking possession and clarifying your ownership of your asset is of primary importance. Far too often in South Florida, real property ownership becomes contested when forged or fraudulent deeds are procured and recorded. One frustrating occurrence that arises in the process of selling or refinancing your property is the discovery of a “cloud on title”. A “cloud on title” refers generally to any claim, lien, or defect that makes it unclear as to who owns or who has a lien on property. In addition to the clouds on title that arise in the context of fraudulent deed and tax deed cases, there are commonly clouds on title in the form of liens. Be it a mortgage that was paid off but never removed from title, a fraudulent lien placed on your property by one who has no right, or some other form of lien on your property that does not belong, the quiet title action is the mechanism by which you invoke the powers of a court to remove these clouds on title.
